以前の記事「欧州で導入が許されるディスクレーマ３種」では、EPC54条（3）の先行技術（日本特許法29条の2の文献に対応）に対して新規性を確保する場合や、非特許事由を除く場合には出願書面に開示されていない特徴を除くディスクレーマ（Undisclosed disclaimer）が許容されると説明しました。
しかし実際に、EPC54条（3）の先行技術に対して新規性を確保する場合や、非特許事由を除く場合においてどのようなディスクレーマを導入すべきか悩むことがあります。
そこで今回の記事では以下に実際に欧州特許庁の審判部において許容されたいくつかのUndisclosed disclaimerの具体例を紹介します（赤字がUndisclosed disclaimer部分）。
T 0717/99
