欧州移行期間徒過の救済期間はいつまでか？

PCT出願の欧州移行期限は31月ですがこの期限を徒過してもFurther Processing という手段により移行可能であることはよく知られています。

それではFurther Processing が可能なのはいつまででしょうか？

EPC規則135条（1）によりFurther Processing は権利喪失の通知（the communication concerning either the failure to observe a time limit or a loss of rights）から2月とされています。

Rule 135
(1)Further processing under Article 121, paragraph 1, shall be requested by payment of the prescribed fee within two months of the communication concerning either the failure to observe a time limit or a loss of rights. The omitted act shall be completed within the period for making the request.

また権利喪失の通知日はEPOのRegisterから確認可能です。

例えばWO2022/035139の例ではEPOのRegisterで2023年3月31日に権利喪失の通知があったことがわかります。

この例ではFurther Processingによって欧州移行が可能だったのは：

2023年3月31日+2月＝2023年5月31日

までだったということになります。
