欧州特許庁によって欧州特許が付与された後は保護を求めるEPC加盟国で権利を有効化（Validation）する必要があります（「Validation」っていったい何のこと？という方はこちらのPDF資料をご覧ください）。
この有効化では各EPC加盟国で代理人を指定したり、庁費用を納付したり、場合によっては翻訳文を納付したりする手続きが必須と思われがちです。しかし以下のEPC加盟国では有効化に何ら要件が定められていません。すなわち以下のEPC加盟国での有効化には何の手続きも必要ありません。
・ドイツ
・フランス
・アイルランド
・ルクセンブルク
・モナコ
・スイス
・リヒテンシュタイン
・イギリス
・ベルギー
つまりこれらのEPC加盟国では仮に有効化の指示をしなかったとしても欧州特許公報の公告後に権利が自動的に有効化されます（EPC64条（1））。有効化をしたつもりがないEPC加盟国の特許庁から特許維持年金のリマインダーが日本に直接送られてくることがあるのはこのためです。

“Under Article 64(1) EPC (or the relevant national legislation in the extension and validation states), a European patent automatically confers on its proprietor from the date on which the mention of the grant is published in the European Patent Bulletin, in each contracting state in respect of which it is granted, the same rights as would be conferred by a national patent granted in that state.
Accordingly, the proprietor needs to take no action before the central industrial property office in respect of European patents granted for Belgium, France, Germany, Ireland, Luxembourg, Monaco, Switzerland/Liechtenstein or the United Kingdom.”
