EPC規則２８条（２）は２０１７年７月１日に発効し、本質的に生物学的な方法により得られた植物および動物を特許の対象外とすることを規定する規則です。この規則は欧州特許庁の拡大審判部による欧州特許条約（EPC５３条（ｂ））の解釈に反するとして導入当時から物議の的となっていました。そしてこの度、欧州特許庁の審判部がEPC規則２８条（２）を無視し、拡大審判部によるEPC５３条（ｂ）の解釈を優先した判決を下しました（T1063/18）。

「規則２８（２）が拡大審判部によって解釈されたEPC５３条（ｂ）と矛盾していることを確認した以上、EPC１６４条（２）の観点から欧州特許条約の規定を優先すべきである。」
“Having established that Rule 28(2) EPC is in conflict with Article 53(b) EPC as interpreted by the EBA and in view of Article 164(2) EPC, it must be concluded that the provisions of the Convention prevail.”

Art. 53 EPC
European patents shall not be granted in respect of:

Rule 28(2) EPC
Under Article 53(b), European patents shall not be granted in respect of plants or animals exclusively obtained by means of an essentially biological process.
Art. 164(2) EPC
In case of conflict between the provisions of this Convention and those of the Implementing Regulations, the provisions of this Convention shall prevail.
